Is there a requirement to have a person(s) overseeing non-licensed asbestos works – supervisory status?
If so, what is the required competency/training for that role?
Regarding the training element for non-licensed asbestos works there is no specific training course identified for supervisors only the generic non-licensed course.
However, those undertakings works should be deemed competent by the employer as per the HSE, Control of Asbestos Regulations 2012, para 40:
“Competence
40 Any reference in this document to competence, competent persons or competent employees is a reference to a person or employee who has received adequate information, instruction and training for the task being done and can demonstrate an adequate and up-to-date understanding of the work, required control measures and appropriate law. They must also have enough experience to apply this knowledge effectively”.
Depending on the level of competence, this may mean increased levels of supervision for workers, para 39:
“Supervisory work
39 Supervisory work’ means work involving direct supervision over those removing, repairing or disturbing asbestos. This applies to supervisory work for both licensable and non-licensable activities”
It all basically boils down to the competence of those undertaking the work.
